“Observe, Document, Submit, & File!”
(A proven process to defend your business against claims and settlements)

Picture this...

· A customer claims she slipped outside your store.

· A company vehicle collides on the road.

· An employee is hurt at work.

What do these have in common? They all put a target on your back. Liability; Lawsuits; and Settlements that can spiral out of control.

After calling for medical help, here’s the playbook that protects you:

OBSERVESnap photos of the scene. Record what the injured person says on your phone. Get witness statements immediately. Memories fade—evidence doesn’t.

DOCUMENTWrite down exactly what happened. Type up the conversations you recorded. Print and store your photos. Build a simple timeline. Organized evidence beats vague memories every time.

SUBMITReport the incident right away to HR. Contact your attorney, then hand over your photos, notes, and recordings. Your lawyer and insurer can’t defend you without documentation.

FILE – Lock it down. Keep every note, photo, and recording safe and secure. Operate under one assumption: lawsuits are coming.

And one more thing—never, ever talk directly with the other side’s attorney. Your only response should be: “You’ll need to speak with HR or my lawyer.” Period.

Here’s the truth: if you run a business and carry insurance, it’s not if you’ll get sued, it’s when. This four-step process won’t stop the lawsuit, but it will protect both your company’s future…and yours!
